1.
General
condition
1.1.
Submission of the reservation form constitutes your full
acceptance of these booking terms and conditions. Please
read them carefully. The booking terms and conditions
together with the general information on the website
constitute the basis of your rental agreement with the owner
of Dubai Desert Paradise Villa, Villa 1, Street 1A,
Savannah, Arabian Ranches, Dubai, United Arab Emirates.
1.2.
REFERENCES
1.2.1.
“You” or “your” refers to the Principal Guest (the Client)
named in the Reservation Form, and by extension all the
guests in the party of the Principal Guest, identified on
the Form
1.2.2.
“Client” refers exclusively to the Principal Guest named on
the Reservation Form
1.2.3.
“We”, “us”, or “our” means the owner(s) of Dubai Desert
Paradise Villa (a Division of Hambro Trading LLC, Dubai, UAE)
2.
IDENTITY AND CAPACITY OF GUESTS
2.1.
The Reservation Form must be completed by the Principal
Guest (the Client) who must be aged 18 years or above. In
doing so, the Client certifies that he or she is authorized
to agree to these booking terms and conditions on behalf of
all guests included on the Reservation Form, including those
added or substituted at a later date at the owner’s
agreement. The owner must be notified of any such changes
immediately. You are prohibited from subletting, sharing or
assigning the property and any violation will be deemed as a
breach of agreement and all guests may be asked to leave the
villa without compensation.
2.2.
Only the persons named on the Reservation Form are allowed
to stay in the villa. The identity of each guest will be
verified on arrival at the villa.
3.
BOOKING PROCEDURE
3.1.
Following receipt of your Reservation Form and Booking
Deposit, we will, subject to availability, confirm your stay
by issuing a confirmation/acknowledgement invoice by email.
This invoice will be sent to the Client. A binding
agreement between you and us comes into effect upon dispatch
of our confirmation invoice to the principal guest.
4.
PAYMENT SCHEDULE
4.1.
To
confirm your stay, we require a booking deposit of 30% of
the total amount (or full payment if booking is within 8
weeks of arrival) to be paid at the time of
reservation. This deposit is not refundable in the event of
your cancellation or failure to pay on time as set out
below.
4.2.
The final balance of the total cost of your stay must be
received by us not less than 8 weeks prior to your arrival.
This date will be shown on the confirmation invoice.
5.
SECURITY DEPOSIT
5.1.
A security deposit of £250.00
is due eight (8) weeks prior to your arrival (or at time of
booking if less than 8 weeks to arrival) and is payable
together with the final balance. We reserve the right to
demand additional deposit amount in some circumstances. The
cost of any damage to the villa or to any items in and/or at
the villa caused, or any service charges incurred by you or
any member of your party (such as telephone calls, excess
cleaning costs, excessive utility bills) will be deducted by
us from the security deposit at the end of your stay. If no
deductions are required, a check of your security deposit
will be refunded in full within 10 business days after your
departure from the villa. If the security deposit is not
sufficient to cover the damage caused or service charges,
you will be responsible for paying the amount of the
shortfall immediately upon request.
If you fail to do so, you will be responsible for meeting
any legal costs we incur in full in recovering full payment
from you.
6.
MINIMUM
STAY
6.1.
Reservations are for a minimum of 3 nights (other than by
prior arrangement with the owner).
7.
ARRIVAL/DEPARTURE
7.1.
Check-IN: The villa is available after 5:00 PM (local
time) on the day of arrival. Late arrival may be
accommodated. You will be required to show your confirmation
invoice on arrival and to prove your identity and that of
other guests in your party as matching those listed in the
Reservation Form.
7.2.
Check-OUT: The villa must be vacated by 10:00AM on
the day of departure - this is to allow our housekeeping
staffs time to prepare the villa for the next guests.
Unless otherwise arranged and agreed, this checkout time
must be strictly enforced to allow housekeeping time to
prepare the home for the next guests. If you should require
a late check-out, please contact the owner who will try to
accommodate your request (if at all possible) – please note
this is entirely dependent upon the arrival date & time of
the next guests and is at the discretion of the owner.
7.3.
The villa rental is only for the dates and times agreed to
in the Reservation Form. Any attempt to enter the villa
before the agreed upon time is not acceptable and any
violation will result in you being charged double the daily
rate for each day (or portion of a day) that the villa is
occupied outside the agreed rental dates and times.
Deductions will automatically be made from your security
deposit.
8.
AMENDMENTS
8.1.
Alterations/amendments after the booking has been confirmed
can be made at the owner’s discretion. We will endeavor to
accommodate such requests but without guarantee or
liability. A processing fee may be chargeable for such
requests.
9.
CANCELLATION
9.1.
Booking Cancellation by you: You are required to submit to
us in writing the request to cancel the booking. The notice
will become effective when received by us. A cancellation
charge will be deducted from the amount paid depending on
when the cancellation notice is received as per the
following schedule:

9.1.1.
Failure to pay an outstanding balance by the due date will
be taken as cancellation by the client and the above
cancellation charges will apply.
9.2.
Booking
cancellation by owner: If, due to circumstances beyond the
owner’s control it is necessary to cancel the rental
agreement, the owner will refund any monies paid by the
client, without interest or further compensation. The owner
may at his discretion offer alternative accommodation of
equal or better standard as an alternative to a full refund,
subject to there being any availability of alternative
accommodation
10.RENTAL RATE GUARANTEE & DISCLAIMER
10.1.
The prices quoted are subject to change. However, the rental
rate for the villa is fully guaranteed once the deposit has
been paid and the confirmation or acknowledgement invoice
has been issued.
10.2.
The website is a guide to the quality and description of
the villa only and does not form part of any contract. We
make every effort to ensure the correctness of the
information contained on the website but makes no warranties
and/or guarantees as to the completeness or accuracy of such
information. The owner reserves the right to make any
modifications deemed necessary. In the event that
unintentional errors, mistakes or omissions occur,
we cannot accept any liability for these details.
11.
SMOKING
POLICY
11.1.
For the comfort and safety of our guests, smoking is not
permitted anywhere in the home. However, guests may smoke in
the pool area and surrounding gardens. Resin ashtrays are
provided for guests use. If guests are found to have smoked
inside the villa, the full security deposit will be
forfeited to cover the costs of cleaning the Air
Conditioning System and fumigating furnishings, etc... We
reserve the right to pursue the Client for any additional
charges as a result of having to relocate future guests
whilst our villa is being cleaned and fumigated.
12.
animals
and pets
12.1.
Animals and Pets are not permitted in the home. This
condition is strictly enforced. Failure to comply will
result in you being asked to leave the villa without any
compensation and the full security deposit will be forfeited
to cover the costs of professional cleaning of the carpets
and furnishings, etc.
13.
SWIMMING POOL
13.1.
Use of the swimming pool is at the client’s own risk. Guests
are specifically advised not to allow unsupervised children
near the pool. No diving is allowed. No glass of any kind is
allowed in the pool area. All rules for the use of the
swimming pool must be observed. Persons failing to comply
after warning will be required to leave the villa without
compensation.
14.
CONSIDERATION FOR NEIGHBORS & PARTIES
14.1.
We
expect all clients to have consideration for other people.
If in our reasonable opinion or in the reasonable opinion of
any other person in authority, you or any member of your
party behaves in such a way as to cause or be likely to
cause danger, upset or distress to any third party or damage
to the property, or in any way damage the reputation and/or
goodwill of the Owners,
we are entitled, without prior notice, to evict the person(s)
concerned from the villa. We will have no further
responsibility toward such person(s). No refunds will be
made and we will not pay any expenses or costs incurred as a
result of the termination.
14.2.
Out of respect for the rights of neighbors, it is a
condition of this agreement that excessive noise or other
nuisance is not allowed and that the rules for the use of
the villa will be observed. Persons failing to comply after
warning will be required to leave the property without
compensation. DO NOT have music on with doors or windows
open, there is a strict noise ordinance in the community and
you could possibly be cited for noise violations.
14.3.
DO
NOT attempt to move furniture without owner’s prior consent.
14.4.
We
reserve the right to decline all male or all female parties.
Groups must be of the size specified on the Reservation
Form. Failure to comply will render the booking void and
give us the right to evict your party from the home without
compensation.
15.
Holiday/travel insurance
15.1.
No
liability is accepted by the owner whatsoever for death,
personal injury, accidents, loss or damage to persons or
personal effects however caused as a result of the use of
the villa or pool. This waiver extends to people visiting
the villa as guest of the client(s).
15.2.
It is
your responsibility to arrange adequate travel insurance
cover during your vacation at Dubai Desert Paradise Villa.
We strongly recommend that you
take out this insurance to cover unforeseen circumstances
which may necessitate cancellation of your vacation.
16.
special
requirements
16.1.
If
you have any special request, you must advise us at the time
of booking and clearly note it in the Special Requirements
box of the Reservation Form. While we will endeavor to meet
reasonable requests we cannot guarantee that all requests
will be met.
16.2.
Failure to meet any special request will not be a breach of
agreement on our part.
16.3.
We
cannot accept bookings that are made conditional to the
fulfillment of a particular request. All such bookings will
be treated as “standard” bookings subject to this provision
on special requests.
17.
physical/medical conditions
17.1.
If
you or any member of your party has any medical problem or
disability that may affect your stay, please tell us before
you confirm your booking so that we can advise as to the
suitability of the chosen arrangements. In any event, you
must give us full details in the Special Requirement box on
the Reservation Form at the time of booking.
17.2.
If
we are unable to properly accommodate the particular needs
of the person concerned, we reserve the right to decline the
reservation or, if full details are not given at the time of
booking, cancel when we become aware of these details.
18.
PASSPORT
AND VISAS
18.1.
It
is your responsibility to ensure that you are in possession
of all necessary travel and health documents including
passports and visas (where applicable) before departure. You
must pay all costs incurred in obtaining such documentation

FORCE
MAJEURE
19.1.
We regret
that we cannot accept responsibility whatsoever or pay any
compensation where the performance or prompt performance of
our contractual obligations is prevented or affected by, or
you otherwise suffer any delay, damage or loss as a result
of, "force majeure". In these Booking Conditions, "force
majeure" means any event which the owner could not, even
with all due care, foresee or avoid. Such events may include
war or threat of war, riot, strikes, civil strife, actual or
threatened terrorist activity, industrial dispute, natural
or nuclear disaster, adverse weather conditions, closure of
airports, fire and all similar events outside the owner’s
control.
